Use of eFarmer portal – General terms

1. Definition of the scope

The international www.efarmer.(sk, cz, pl, hu) internet portal has been developed within the frame of the EDC 11221 Project of the European Commission with a duration from 01/2005 until 04/2007. The consortium of the project (see Consortium) entrusted the development and implementation to the provider (central email address: efarmer@efarmer.sk). Users from Slovakia, Czech Republic, Hungary, and Poland can find useful contact addresses on the contact page of the eFarmer Portal.

To access the eFarmer portal you have to comply to the general conditions and terms. When entering the portal and prior to user registration, it is necessary to confirm you understand and agree to these terms. Terms of personal data protection are explained in detail on the Privacy section of the eFarmer Portal.

This document refers to the usage of services and information as well as the rights and duties in relation to the provider, user of services, and any third parties.

2. Provided services and information

The eFarmer portal user may be a natural person or legal entity using the services and information provided by this system. The portal offers the user information, documentation and guidance concerning agricultural issues in their respective countries. In particular it provides assistance to the user for the processing of agriculturally related claims, relevant documentation and status reports which are linked with the corresponding area including an archiving service useful for future claim preparations. Standard services and information are currently accessible to everyone through the eFarmer portal when he/she:

  • undertakes proper registration, and
  • accepts the terms explained further in the document.

Special services and information requested by the user towards the provider shall be dealt with in additional conditions.

The user is entitled to order services on his own behalf and with his own account in favour of third parties. In such case the user of these services is obliged to ensure that the third parties use the services in conformity with the regulations of these Terms, additional conditions, other conventions published on the website: www.eFarmer.sk, national legislation of V-4 countries, and good moral.

The user is entitled to allow third parties ordering Services on his behalf and his account through registering the third parties without disclosing their personal data. The beneficiary of such services is entitled to register such third party which agrees with the registration, general terms and additional conditions.

The third party is understood to be a person that provides information (e.g. through discussion), or from whom the provider collects information (e.g. news, documents), or national rural payment agencies, or any Internet services agent.

3. Terms of portal use

Currently services and information provided by the eFarmer portal are free of charge except for special user requests. Consequently the terms are focused on how to use this information and know-how. Three types of information are provided by the portal:

  1. Information related to the processing of your claims and documents
  2. Information provided from provider´s sources
  3. Information taken over by the provider from other sources

Information of the first group can be stored, displayed, updated, deleted, downloaded to your computer, or printed for your own needs and purposes, that is, for submission to the payment agency. You can process your information through the different portal functionalities accessible after your registration.

In view of the terms this information is under your full control by logging into the eFarmer Portal. Except for personal data protection, further explained in the Privacy  section of this portal, the provider does not carry any responsibility for this information.

The provider´s duty is to ensure confidentiality of the password and to apply measures to prevent its misuse. The user is responsible for all the activities resulted from the improper use or misuse of password, or other forms enabling unwanted access to the services. Concequently he is obliged to change his password if suspicion arouses an unauthorized person took knowledge of the password.

The user commits himself, without delay, to notify the provider about any unauthorized access or breach in the security he is aware of. The provider is not responsible for damages caused by password misuse or any other access code by unauthorized persons.

For the second and third group of information it is the duty of the user to observe all author´s rights or other corresponding rights. You may not distribute, change, transfer, use, or reuse the content of any portal pages for public or commercial purposes (including texts, pictures, audio and video) without prior consent of the eFarmer portal provider. You should be aware that all what you can see or read on the pages is protected by the copyright law (or indicated if different), and cannot be used without the prior consent of the portal provider.

Within the frame of the second group of provided information the provider invests substantial efforts to collect correct and actual information on his website. The provider, however, is not liable for correctness of such information regarding content that is taken over and provided through the portal in an "as is" form within the frame of the third group of information (e.g. discussion, email, link allocations). In such case the user of the portal services is responsible for any damage or loss caused by the violation of third parties' rights.

The provider is not liable and cannot be taken responsible for any damages resulting from action of the third parties or viruses that could infect your computer equipment or other accessories when you enter, use, and/or download information from the eFarmer portal. Concurrently, the user´s duty is not to undertake unauthorized interference within the eFarmer portal.

At any moment in time the provider has the right to discontinue the provision of services towards a particular user of services or third party whenever he/she misuses services, or if there exists any suspicion of their misuse. Parallely, he has the right to apply complementary portal and access protection for portal users. The user is obliged to respect and accept additional protection measures.

The provider has the right to inform the user by emails about services provided by the portal, or to use other forms of written communication based on user consent only. Conversely, the user of services has the right at anytime to disallow such contact through the manifestation of will delivered to the provider in written or electronic form. The user has the right to provide information on difficulties, needs, or requirements directly to the provider using the portal functionalities.

The provider is not liable for portal access services provided by third parties, for low quality, dropouts, or consequences resulting from the provision of services ensuring communication through internet, for security, loss, alteration, corruption, or destruction of information transferred through these services.

Within the eFarmer portal the provider is not liable for information automatically and temporarily stored by the user for his own usage, does not alter this information, observes the terms of information accessibility and generally recognized and applied rules for information database updating, does not apply technologies for illegal use of the stored information, and without delay removes corresponding system data upon getting knowledge that the user removed or cancelled the access.

4. Other terms

The provider has the right to remove available documents without delay in case of illegal content of stored information, or when he takes knowledge of illegal action of the user. Nevertheless, it is the user who is liable for such information.

In connection with the development of portal services, the provider may update or redefine these terms. As the user is bound by any changes it is his duty to regularly visit this section of the eFarmer Portal. The provider shall inform the user about major changes through information published on the portal or by email.

The provider and the user are liable for damages caused by them as a consequence of violation of duties explained in corresponding legal regulations and terms. This only when it can be proved that the violation of duties resulted from circumstances excluding their responsibility, if not indicated otherwise. It is in case of obstruction that occurred outside the liable parties' will and impedes it to fulfill its duty (e.g. natural disaster, power cut).

The provider has the right to inform the user about Services provided by www.eFarmer.sk with letters, leaflets, direct mails, or other written forms.
