Personal data protection - Privacy
With respect to international project features, the eFarmer portal provider (hereinafter provider only) applies the joint approach to legal principles of the European Union Member States valid for personal data protection. Article 8 of the Directives No 95/46/ES regulates processing of the most sensitive personal data which are indicated as the so-called "Particular category of personal data".
On the other hand the provider has to respect the laws applicable in respective countries. For processing purposes he proceeds as per the Code No 428/2002 of the Collection of Laws on personal data protection including the Code No 90/2005 of the Collection of Laws.
1. GUARANTEE OF PROTECTION
The concept of "personal data" in connection with this Personal Data Protection document refers to information such as:
- name, date of birth, e-mail address or regular mail address,
- and mainly birth number which can be used for identification purposes only or for your own needs.
The provider shall not process your personal data without your consent. When processing personal data the corresponding law on personal data protection shall be observed. Our employees are strictly bound by standards of security and secrecy. The following paragraphs explain how and where the collected personal data will be used.
2. USE OF PERSONAL DATA
Most of our services need prior registration before accessing them. When proceeding registration you shall fill in certain data (some mandatory, some optional) while you are free to select username and password.
Should you decide not to provide some of the required personal data you may not gain access to particular parts of our website and/or no response on your queries and questions may come.
The provider uses only some personal data for specific and limited purposes; we notify you about it on your request. These data help you to receive our services, allow us to charge you for products and services ordered by you, offer you our new services which we think might be interesting, or communicate with you for other reasons. Information sent to our contact address is used for help only and to assist you in solving your problem; otherwise it remains undisclosed.
The provider saves these data when it is legitimately required for certain purposes and it is in compliance with legal procedure linked with their storage. All remaining data related to processing of documents and forms for selected support are linked with your name and password. Anytime they can be changed or deleted with respective functions.
3. NON-DISCLOSURE OF INFORMATION
The provider shall not forward, share, nor distribute your personal data to third persons. Upon introduction of electronic document submission services we shall inform you in time.
Further processing shall comply with the purpose(s), for which data are collected. In such case the use of the data shall distinctly be specified. Third parties may have different personal data protection related policy. The provider shall endeavour to ensure the third parties to handle the data the same way as his, and where necessary he shall request use of entrusted data in a contract exclusively for defined purpose. Even in this case your express consent shall be required. Your consent may anytime be cancelled and the data deleted from provider´s archive the subsequent day.
Accordingly the provider shall, if possible, notify the third parties that were provided with these data on withdrawal of your consent.
4. ACCESS RIGHTS
By using your username and password you log into the portal and gain access. You can modify your personal data or you may delete them. We shall ensure through the portal functionalities that you might update or verify their accuracy and completeness. Your problems shall be solved promptly. Likewise requirements for deletion of your personal data shall be solved simply based on your request without commitment to save them with the provider.
5. PROTECTION AND CONFIDENTIALITY OF INFORMATION
To ensure protection and confidentiality of personal data collected on-line, the provider uses protected networks, internet units, standard security systems, and protection passwords.
Access to personal data is restricted to those employees who may need these data and to those that have duly been trained on correctly handling such data, and who thoroughly follow strict information standards of confidentiality (secrecy).
Should an employee fail to follow our policy of personal data protection, consequences shall be drawn. Our personnel is regularly checked and examined for observance of our policy and procedures.
6. DATA TRANSFERRED ABROAD
The provider may transfer your personal data to one of its databases out of your country. If personal data protection standards in that country do not comply with internationally recognized standards, we shall ensure adequate protection of data transferred to provider´s databases in another country. The provision of these data to third parties in those countries shall not take place unless we receive your consent for such transfer.
7. ANONYMOUS DATA AND "COOKIES"
Most information retrieved by the provider from its internet page is anonymous such as: pages you visited and search commands you have undertaken. When visiting our portal we do not collect personal data unless approved by you through regular registration. Anonymous information of the provider is processed to enhance the page content and to develop overall statistics on individual use of our site for internal and marketing purposes. The provider may install "cookies" to collect domain names on the first level from users (e.g. to follow the number of hits and access times). "Cookies" as such may not be used for disclosure of user´s identity. A "Cookie" is a small part of information that is sent to your browser and stored on your computer hard drive. "Cookies" cannot harm your computer. You can setup your computer so it notifies you on receipt of cookies. This way you can decide whether to accept or reject cookies.
8. UNSOLICITED EMAILS
The provider does not tolerate unsolicited emails. Unsolicited emailing is defined as unsolicited email communication of commercial nature in large quantity and repeatedly to individuals with whom the sender had no contact before or who refused such communication. Conversely, if the provider is convinced that certain product or information is important for you he reserves the right to inform you about such mail and gives you the right to opt for such service.
9. PERSONAL INFORMATION, USER AND CHILDREN
You are the user of the portal or a person authorized by you. The authorized person (that fills in data on your behalf) must have your consent. In case your claim and documents are submitted by the applicant, a power of attorney is often required as part of the claim. The provider shall not willfully collect, use, or disclose personal data of minors under 13 without prior consent of his/her responsible person (e.g. parents or guardian) through direct off-line contact. We shall make parents acquainted with specific types of personal data obtained from children and with the option to reject the use or storage of that information. The provider abides by the law on protection of data obtained on-line from children and respects similar laws enacted for protection of children in other countries, as well.
10. OTHER LINKS
This policy of personal data protection refers to the eFarmer.sk provider´s internet pages only and not to internet pages of third parties. The provider may disclose links of other internet pages that we think are interesting for our visitors. Our objective is to fulfill superior standards for these pages.
